Notice on the Ballast Water Convention on the point of Satisfying the
Condition for Entry into Force
The International Convention for the Control and Management of Ships’ Ballast Water and Sediments, 2004 (hereinafter referred to as “the Ballast Water Convention” or “the Convention”) was adopted by the International Maritime Organization (IMO) in February 2004, which will enter into force twelve months after the date on which not less than thirty States, the combined merchant fleets of which constitute not less than thirty-five percent of the gross tonnage of the world’s merchant shipping, have ratified it.
In accordance with the latest information of IMO, up to 25 June 2014, 40 States the combined merchant fleets of which constitute approximately 30.25% of the gross tonnage of the world’s merchant shipping ratified the Convention. CCS leaned from the first session of the Sub-Committee on Implementation of IMO Instruments (III Sub-Committee) which was concluded on 18 July that Japan (2.78%), Turkey (0.27%) and Italy (0.46%) have completed domestic ratification process and will soon accede to the Convention as well as that Indonesia (0.85%) will soon complete domestic ratification process. The gross tonnage has reached 34.61%, only falling short the condition for entry into force by 0.39%. It is expected that the condition for entry into force will be satisfied around the beginning of 2015 at the earliest and the Convention will enter in force at the beginning of 2016 (the analysis below is based on the estimation).
A. Timeline for implementation of D-2 standard (ballast water performance standard)
For ships with different dates of construction, they are required by the Convention to comply with the mandatory D-2 standard (ballast water performance standard) before a specific date. At present compliance with this standard is achieved basically by installing on board Ballast Water Management Systems (BWMS) which have been type approved and only those BWMSs which have been type approved are allowed to be installed on board. As it is allowed by the Convention that Port State Control (PSC) can carry out sampling analysis of ballast water of ships calling at the port and
determine ship’s compliance with D-2 standard, relevant parties are concerned about “whether the method of sampling analysis used by PSC is consistent with that used for type approval of BWMS”, because of which only a small number of ships have installed BWMS and which is also the most important reason for delaying the entry into force of the Convention. Consequently, resolution A.1088(28) (see Annex 3) was adopted by IMO on 4 December 2013, which has adjusted the timeline given in regulation B-3 of the Convention for compliance with D-2 standard with regard to ships with different dates of construction (the Convention will be amended accordingly after entry into force):

First renew survey means the renewal survey under MARPOL Annex I. For ships, D-1 standard shall be satisfied before implementation date of D-2 standard.
Anniversary date of delivery of the ship means the day and the month of each year, which will correspond to the date of delivery of the International Oil Pollution Prevention Certificate.
B. Suggestions on coping by the industry
1. Shipowners/management companies
a) Newbuildings
For ships constructed (“constructed” in respect of a ship means a stage of construction where the keel is laid, see “Definitions” in Regulation A-1 of the Convention) after entry into force of the Convention (around the beginning of 2016, hereinafter the same), D-2 standard must be satisfied. For ships for which the building contract has been signed, is being prepared for signing or will be signed, consideration must be given to installation of BWMS if the planned keel-laying date is after the beginning of 2016.
For ships for which the building contract has been signed or is being prepared for signing at present, shipowners/management companies are recommended to consult with shipyards (and/or designers) as soon as possible on subsequent coping measures (including revising existing design in accordance with specific ship condition and route, purchasing and installing BWMS etc.) after the date of issuance of the notice, if the planned keel-laying date is at the beginning of 2016. For ships for which the planned keel-laying date is before the beginning of 2016, it is recommended to carry out a preliminary type selection of BWMS and revise existing design (if BWMS is not considered during design) at present for such ships, in order to make preparations for future modifications. Consideration may also be given to installation of BWMS during construction stage (especially for ships for which the keel-laying date is close to 1 January 2016).
For ships for which keel has been laid and at the construction stage at present, in accordance with resolution A.1088(28), BWMS is not required to be installed at the initial survey carried out upon completion of construction (which may be extended to the first IOPP renewal survey), but it is recommended to carry out a preliminary type selection of BWMS and revise existing design (if BWMS is not considered during design) at present for such ships, in order to make preparations for future modifications, see Guidelines for Implementation of the Ballast Water Convention (2014) issued by CCS.

b) Ships in service
1) For ships in service constructed before 1 January 2009 with a Ballast Water Capacity of between 1,500 and 5,000 cubic metres (inclusive):
For ships subject to IOPP renewal survey in the period from 1 January 2016 to 31 December 2017, it is considered that D-2 standard shall be satisfied immediately upon entry into force of the Convention or at the latest, within two years after entry into force of the Convention. Shipowners/management companies are recommended to contact ship repair yards (and/or designers) and BWMS manufacturer as soon as possible to determine modification plan and type selection of equipment after the date of issuance of the notice. Such ships were mainly constructed in the period from July 2005 to December 2007 (or similar ships before that period estimated by a 5-year cycle).
For other ships for which the IOPP renewal survey is outside the scope above, although such survey will be carried out in or after 2018 when D-2 standard needs to be satisfied, it is recommended to implement by referring to paragraph 3 of
B.1.a).
2) For ships in service constructed before 1 January 2009 with a Ballast Water Capacity of less than 1,500 or greater than 5,000 cubic metres
Where IOPP renewal survey will be carried out to such ships on or after 1 January 2016 and the date of renewal survey is after “the anniversary date of delivery of the ship”, D-2 standard shall be satisfied at the IOPP renewal survey for such ships.
It is to be noted that the Convention will enter into force in 2016 in accordance with current estimation and as a result, for ships for which IOPP renewal survey will be carried out from 1 January 2016 to 31 December 2016 and the date of renewal survey is after “the anniversary date of delivery of the ship”, they might encounter the problem that “D-2 standard must be satisfied and survey and certification must be completed before entry into force of the Convention”: even if the date of entry into force (assuming 31 December 2016 at the latest) is after “the anniversary date of delivery of the ship” or IOPP renewal survey date, D-2 standard shall still be satisfied at the IOPP renewal survey for such ships and survey and certification under the Ballast Water Convention must be completed in conjunction with IOPP renewal survey before entry into force of the Convention, unless the ship applies for IOPP renewal survey in advance which is completed before “the anniversary date of delivery of the ship”. Such ships were mainly constructed in the period from July 2005 to December 2006 (or similar ships before that period estimated by a 5-year cycle). Shipowners/management companies are invited to cope with the problem in advance.
For ships subject to IOPP renewal survey in the period from 1 January 2017 to 31 December 2017, it is considered that D-2 standard shall be satisfied within one year or at the latest, within two years after entry into force of the Convention, it is recommended to implement by referring to paragraph 1 of B.1.b).1). Such ships were mainly constructed in the period from July 2006 to December 2007 (or similar ships before that period estimated by a 5-year cycle).
For other ships for which the IOPP renewal survey is outside the scope above, although such survey will be carried out in or after 2018 when D-2 standard needs to be satisfied, it is recommended to implement by referring to paragraph 3 of
B.1.a).
3) For ships in service constructed on or after 1 January 2009 which has been put into operation with a Ballast Water Capacity of less than 5,000 cubic metres
For ships subject to IOPP renewal survey in the period from 1 January 2016 to 31 December 2017, it is considered that D-2 standard shall be satisfied immediately upon entry into force of the Convention or at the latest, within two years after entry into force of the Convention. It is recommended to implement by referring to paragraph 1 of B.1.b).1). Such ships were mainly constructed in the period from July 2010 to December 2012.
For other ships for which the IOPP renewal survey is outside the scope above, although such survey will be carried out in or after 2018 when D-2 standard needs to be satisfied, it is recommended to implement by referring to paragraph 3 of
B.1.a).
4) For ships in service constructed in the period from 1 January 2009 to 31
December 2011 with a Ballast Water Capacity of 5,000 cubic metres or more
Where IOPP renewal survey will be carried out to such ships on or after 1 January 2016 and the date of renewal survey is after “the anniversary date of
delivery of the ship”, D-2 standard shall be satisfied at the IOPP renewal survey for such ships.
For ships for which IOPP renewal survey will be carried out from 1 January 2016 to 31 December 2016 and the date of renewal survey is after “the anniversary date of delivery of the ship”, they might also encounter the problem described in paragraph 2 of B.1.b).2) above. Such ships were mainly constructed in the period from July 2010 to December 2011. It is recommended to implement in the same manner (for few ships which shall satisfy D-2 standards within one year or at the latest, within two years after entry into force of the Convention, it is recommended to implement by referring to paragraph 1 of B.1.b).1)).
For other ships for which the IOPP renewal survey is outside the scope above, although such survey will be carried out in or after 2019 when D-2 standard needs to be satisfied, it is recommended to implement by referring to paragraph 3 of
B.1.a).
5) For ships in service constructed on or after 1 January 2012 which has
been put into operation with a Ballast Water Capacity of 5,000 cubic metres or more
For ships subject to IOPP renewal survey in the period from 1 January 2017 to 31 December 2017, it is considered that D-2 standard shall be satisfied within one year or at the latest, within two years after entry into force of the Convention. It is recommended to implement by referring to paragraph 1 of B.1.b).1). Such ships were mainly constructed in the period from January 2012 to January 2013.
For other ships for which the IOPP renewal survey is outside the scope above, although such survey will be carried out in or after 2018 when D-2 standard needs to be satisfied, it is recommended to implement by referring to paragraph 3 of
B.1.a).
2. Shipyards/ship repair yards, designers
For newbuildings, implementation shall be in accordance with 3 cases described in B.1.a). For selection of BWMS, on-board arrangement, modification of existing ships as required by shipowners/management companies, see Guidelines for Implementation of the Ballast Water Convention (2014) issued by CCS. At the same time, it is recommended that shipyards/ship repair yards and designers cooperate with shipowners/management companies to apply for CCS survey and certification timely.
3. Equipment manufacturers
Up to 4 April 2014, 33 BWMSs which make use of active substances obtained final approval of IMO and 42 BWMSs (including those not making use of active substances. 11 BWMSs are manufactured in China and the capacity can meet requirements of ships classed with CCS) obtained type approval of Administration/classification society globally. Relevant information is given in Annex 1 and 2. As Guidelines for Approval of Ballast Water Management Systems (G8) has been revised before and it is possible further revision will be made to the Guidelines, users are recommended to pay timely attention to revision of relevant
IMO standards and make corresponding arrangement. CCS will also circulate relevant information.
C. Services provided by CCS and other points of attention
1. Services provided by CCS
CCS can provide external customers with consulting service and relevant training with regard to various ships including special ship types. In addition, when authorized by flag States, CCS can carry out survey and certification before entry into force of the Convention. CCS will actively cooperate with customers to complete plan approval, survey and certification of newbuildings and exiting ships in a timely manner. Relevant implementation details will be released separately.
2. Other points of attention
In accordance with resolution A.1088(28), the start time point of compliance with D-2 standard is the first renewal survey under MARPOL Annex I; However, it is not further detailed by IMO. Besides these cases described in paragraph 2 of B.1.b).2) and paragraph 2 of B.1.b).4), for other ships in service for which the renewal survey under MARPOL Annex I is before or after entry into force of the Convention (i.e. around the beginning of 2016), if they apply for the renewal survey under MARPOL Annex I (such survey maybe completed within 3 months before the expiry date of the existing certificate or more than 3 months before such date) in advance before the date of entry into force of the Convention, and the date of completion of renewal survey is before the date of entry into force of the Convention, ships need not satisfy D-2 standard at such renewal survey under MARPOL Annex I in accordance with current provisions, which may be extended to the next IOPP renewal survey (unless interpretations are otherwise developed by IMO before entry into force of the Convention).
Guidelines for Port State Control (PSC Guidelines) have been developed by the III Sub-Committee based on Guidance on ballast water sampling and analysis for trial use in accordance with the BWM Convention and Guidelines (G2) (BWM.2/Circ.42). It is required by the Guidelines that PSC uses four-stage inspections (initial inspection, more detailed inspection, sampling for indicative analysis and sampling for detailed analysis) in accordance with ship conditions, of which indicative analysis is derived from BWM.2/Circ.42. The final content will be decided by MEPC 67 in October. Additional PSC assessment requirements will also be decided by MEPC 67 as sampling and analysis are involved. Meanwhile, IMO has agreed to further revise the PSC Guidelines in accordance with trial use of BWM.2/Circ.42 (trial use period is 2 to 3 years after entry into force of the Convention).
Ships operating in waters of the United States shall also satisfy requirements for ballast water given in Standards for Living Organisms in Ships’ Ballast Water Discharged in U.S. Waters (33 CFR part 151) issued by USCG and Vessel General Permit (2013 VGP) issued by US Environmental Protection Agency. Detailed are given in Guidelines for Implementation of the Ballast Water Convention (2014) issued by CCS.
It is hereby notified.
The Notice is made public on CCS website (), and be transmitted to the relevant shipyards/ship repair yards, designers, shipowners, ship management companies and equipment manufacturers by the branches/plan approval centers of CCS within their responsible area.
After issuance of the Notice, the plan approval/survey units of CCS are to publicize relevant requirements of the Notice to customers in conjunction with various opportunities of visiting customers (including but not limited to various meeting or talk held regularly or irregularly with ship management companies, shipyards, designers and manufacturers within their responsible area).

It is recommended to implement by referring to paragraph 1 of B.1.b).1). Such ships were mainly constructed in the period from January 2012 to January 2013.
For other ships for which the IOPP renewal survey is outside the scope above, although such survey will be carried out in or after 2018 when D-2 standard needs to be satisfied, it is recommended to implement by referring to paragraph 3 of
B.1.a).
2. Shipyards/ship repair yards, designers
For newbuildings, implementation shall be in accordance with 3 cases described in B.1.a). For selection of BWMS, on-board arrangement, modification of existing ships as required by shipowners/management companies, see Guidelines for Implementation of the Ballast Water Convention (2014) issued by CCS. At the same time, it is recommended that shipyards/ship repair yards and designers cooperate with shipowners/management companies to apply for CCS survey and certification timely.
3. Equipment manufacturers
Up to 4 April 2014, 33 BWMSs which make use of active substances obtained final approval of IMO and 42 BWMSs (including those not making use of active substances. 11 BWMSs are manufactured in China and the capacity can meet requirements of ships classed with CCS) obtained type approval of Administration/classification society globally. Relevant information is given in Annex 1 and 2. As Guidelines for Approval of Ballast Water Management Systems (G8) has been revised before and it is possible further revision will be made to the Guidelines, users are recommended to pay timely attention to revision of relevant
IMO standards and make corresponding arrangement. CCS will also circulate relevant information.
C. Services provided by CCS and other points of attention
1. Services provided by CCS
CCS can provide external customers with consulting service and relevant training with regard to various ships including special ship types. In addition, when authorized by flag States, CCS can carry out survey and certification before entry into force of the Convention. CCS will actively cooperate with customers to complete plan approval, survey and certification of newbuildings and exiting ships in a timely manner. Relevant implementation details will be released separately.
2. Other points of attention
In accordance with resolution A.1088(28), the start time point of compliance with D-2 standard is the first renewal survey under MARPOL Annex I; However, it is not further detailed by IMO. Besides these cases described in paragraph 2 of B.1.b).2) and paragraph 2 of B.1.b).4), for other ships in service for which the renewal survey under MARPOL Annex I is before or after entry into force of the Convention (i.e. around the beginning of 2016), if they apply for the renewal survey under MARPOL Annex I (such survey maybe completed within 3 months before the expiry date of the existing certificate or more than 3 months before such date) in advance before the date of entry into force of the Convention, and the date of completion of renewal survey is before the date of entry into force of the Convention, ships need not satisfy D-2 standard at such renewal survey under MARPOL Annex I in accordance with current provisions, which may be extended to the next IOPP renewal survey (unless interpretations are otherwise developed by IMO before entry into force of the Convention).
Guidelines for Port State Control (PSC Guidelines) have been developed by the III Sub-Committee based on Guidance on ballast water sampling and analysis for trial use in accordance with the BWM Convention and Guidelines (G2) (BWM.2/Circ.42). It is required by the Guidelines that PSC uses four-stage inspections (initial inspection, more detailed inspection, sampling for indicative analysis and sampling for detailed analysis) in accordance with ship conditions, of which indicative analysis is derived from BWM.2/Circ.42. The final content will be decided by MEPC 67 in October. Additional PSC assessment requirements will also be decided by MEPC 67 as sampling and analysis are involved. Meanwhile, IMO has agreed to further revise the PSC Guidelines in accordance with trial use of BWM.2/Circ.42 (trial use period is 2 to 3 years after entry into force of the Convention).
Ships operating in waters of the United States shall also satisfy requirements for ballast water given in Standards for Living Organisms in Ships’ Ballast Water Discharged in U.S. Waters (33 CFR part 151) issued by USCG and Vessel General Permit (2013 VGP) issued by US Environmental Protection Agency. Detailed are given in Guidelines for Implementation of the Ballast Water Convention (2014) issued by CCS.

The Notice is made public on CCS website (), and be transmitted to the relevant shipyards/ship repair yards, designers, shipowners, ship management companies and equipment manufacturers by the branches/plan approval centers of CCS within their responsible area.
After issuance of the Notice, the plan approval/survey units of CCS are to publicize relevant requirements of the Notice to customers in conjunction with various opportunities of visiting customers (including but not limited to various meeting or talk held regularly or irregularly with ship management companies, shipyards, designers and manufacturers within their responsible area).
