刑事起诉书样本

一、被告人基本情况

包括被告人姓名，性别，年龄、出生年月日，出生地，身份证号码，民族，文化程度，职业或工作单位及职务(国家工作人员利用职权的犯罪，应当写明犯罪期间在何单位任何职务) ，住址。是否受过刑事处罚，拘留、逮捕的年月日，在押被告人的羁押处所。

(如果是单位犯罪，应写明犯罪单位的名称，所在地址，法定代表人或代表人的姓名、性别、职务。如果还有应当负刑事责任的“直接负责的主管人员或其他直接责任人员”，应当按上述被告人基本情况内容叙写。)

二、辩护人基本情况

包括姓名、单位、通信地址。

三、案由和案件来源

如果是公安机关侦查终结的案件，写明姓名、案由、案件来源，如“被告人***盗窃一案，由***公安局侦查终结向本院移送审查起诉。”

如果是本院侦查终结的案件，写明姓名、案由、案件来源，如“被告人***贪污一案，由本院依法侦查终结。”

四、案件事实

包括犯罪时间、地点、经过、手段、目的、动机、危害后果等与定罪量刑有关的事实要素，可写为：
